What does an America with a 6–3 Supreme Court really look like? Well, for much of the country things will look pretty much the same, writes Tim Wu. The laws will instead remake themselves state by state, with the Reds getting redder and the Blues getting bluer.

“The bottom line is a Supreme Court that might, in a sense, free the country to split into two; in a historic sense, bringing the country even closer to the two-nation identity that was long associated with pre-civil war period.”
